Terms of Service

1. Acceptance

By creating an account or using OnCall ("the Service"), you ("Customer", "you", "your") agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. CastGlobe Corporation ("CastGlobe", "we", "us") reserves the right to update these Terms with notice as described below.

2. The Service

OnCall is an AI-powered telephony platform for service businesses. The Service includes:

  • AI receptionist (inbound calls)
  • AI outbound calling
  • Lead capture and management
  • Appointment booking
  • SMS follow-up automation
  • Account dashboard and analytics

Service capabilities, integrations, and supported features may change over time.

3. Account Registration

You must provide accurate registration information and keep it up to date. You are responsible for maintaining the security of your account credentials. Notify us immediately at hello@castglobe.com if you suspect unauthorized access.

You must be at least 18 years old and authorized to bind the business you represent.

4. Acceptable Use

You agree NOT to use the Service to:

  • Make unsolicited calls or send unsolicited SMS in violation of TCPA, CASL, or similar laws
  • Call numbers on Do Not Call registries you don't have a prior business relationship with
  • Impersonate others or misrepresent your business
  • Engage in fraudulent or illegal activity
  • Reverse engineer, decompile, or copy the Service
  • Resell access to the Service without our written agreement (agency partnerships are available — contact us)
  • Operate the Service in industries we don't permit (currently: adult content, gambling outside licensed operators, multi-level marketing schemes)

We reserve the right to suspend or terminate accounts violating these terms.

5. Pricing and Payment

The Service operates on a pay-as-you-go basis:

  • Wallet top-up minimum: $50 USD
  • Inbound calls: $0.24 per minute (billed per minute, rounded up to the nearest minute)
  • Outbound calls: $0.30 per minute (billed per minute, rounded up to the nearest minute)
  • Phone numbers: $1 first-month activation, then $10/month per number
  • Platform fee: $39/month (waived for the first 30 days)
  • SMS messages: $0.03 per message
  • All prices subject to change with 30 days notice

Failed payments may result in suspension. Wallet balances do not expire while your account is active. Unused balances are non-refundable upon account termination by you, but refundable upon account termination by us at our discretion.

6. Cancellation and Refunds

You may cancel your account at any time from your dashboard. Upon cancellation:

  • Active campaigns stop
  • AI agents are deprovisioned
  • Phone numbers are released after a 30-day grace period
  • Unused wallet balance is non-refundable in standard cancellations
  • Refund requests for billing errors must be submitted within 30 days

7. Intellectual Property

CastGlobe owns the Service, including software, designs, content, and trademarks. You retain ownership of:

  • Your business data
  • Lead information you capture
  • Knowledge base content you upload
  • Recordings and transcripts of your AI's calls

We use your data only to operate the Service and as described in our Privacy Policy.

8. Service Availability

We target 99.5% uptime but do not guarantee uninterrupted service. The Service may be unavailable due to maintenance, force majeure, or third-party service outages (Twilio, VAPI, Stripe). Critical outages may be communicated via email or status page.

9. AI Limitations and Disclaimers

The Service uses AI agents that may make errors. By using the Service, you acknowledge:

  • AI responses are generated and may contain inaccuracies
  • AI cannot replace professional judgment in medical, legal, financial, or safety-critical situations
  • You are responsible for monitoring AI conversations and intervening when needed
  • We provide tools for human takeover and AI configuration; you are responsible for using them appropriately

CastGlobe is not liable for outcomes resulting from AI-generated responses, including misquoted prices, missed appointments, or incorrect business information conveyed to your callers.

10. Limitation of Liability

To the maximum extent permitted by law, CastGlobe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunities.

CastGlobe's total liability for any claim arising from these Terms or your use of the Service is limited to the amount you paid for the Service in the 12 months preceding the claim, or $1,000, whichever is greater.

11. Indemnification

You agree to indemnify CastGlobe from claims arising from your use of the Service, including TCPA/CASL violations, copyright claims, defamation, or other legal violations stemming from how you've configured or used your AI agents.

12. AI Disclosure — Subscriber Responsibilities

OnCall by CastGlobe ("OnCall") provides artificial intelligence services that conduct automated voice calls, text messages, and chat conversations on behalf of subscriber businesses ("Subscribers"). OnCall's AI agents are configured by default to identify themselves as AI to callers and visitors at the start of each interaction.

Subscribers may, through configuration settings within their OnCall account, change the timing or wording of this AI disclosure. Subscribers may also choose to defer the disclosure unless explicitly asked. In all configurations, OnCall's AI agents will honestly identify themselves as AI when directly asked by a caller, visitor, or customer. This honesty rule is non-negotiable and cannot be overridden.

Subscriber acknowledges and agrees that:

  • Various jurisdictions, including but not limited to the State of California (Senate Bill 1001), the State of Utah (Artificial Intelligence Policy Act), the State of Colorado (Colorado Artificial Intelligence Act, effective 2026), and the European Union (EU AI Act), have laws that may require AI systems to disclose their non-human nature to consumers, customers, or end users in certain circumstances.
  • Subscriber, not OnCall or CastGlobe Corporation, is solely responsible for ensuring that Subscriber's chosen AI disclosure configuration complies with all applicable federal, state, provincial, and local laws in every jurisdiction where Subscriber's customers, leads, or contacts may be located.
  • By configuring AI disclosure to anything other than the default "Friendly" mode, Subscriber accepts full responsibility and liability for compliance with all applicable laws, and indemnifies OnCall and CastGlobe Corporation from any claims, fines, penalties, or legal action arising from Subscriber's chosen disclosure configuration.
  • Subscriber will record proof of acknowledgement when changing AI disclosure settings, and OnCall will retain logs of these acknowledgements for the duration of the Subscriber's account plus seven (7) years for compliance purposes.

13. Restricted Jurisdictions

OnCall does not currently provide service to businesses operating in or contacting consumers in certain jurisdictions where the legal landscape for AI voice and chat services is unclear or under active regulation. The current list of restricted jurisdictions is published at castglobe.com/restricted-jurisdictions and may be updated from time to time. Subscribers represent that their primary place of business is not in a restricted jurisdiction at the time of signup. Subscribers further agree to notify OnCall if their place of business or service area changes such that their use of OnCall would involve a restricted jurisdiction.

14. Customer Communications Compliance

Subscriber represents and warrants that all phone numbers, email addresses, and other contact information uploaded to OnCall or used through OnCall's services have been collected with appropriate consent under all applicable laws, including but not limited to the United States Telephone Consumer Protection Act (TCPA), Canada's Anti-Spam Legislation (CASL), the EU General Data Protection Regulation (GDPR), and similar regulations. Subscriber will scrub their contact lists against the National Do Not Call Registry and any state-level Do Not Call lists before initiating outbound calls or messages. OnCall is not responsible for verifying Subscriber's compliance with these laws.

15. Modifications

We may update these Terms. Material changes will be communicated via email to active account holders at least 30 days before taking effect. Continued use after changes constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Disputes will be resolved in the courts of Toronto, Ontario.
